FISA and the Obama Wire Taps

Trump unleashed a series of tweets over the weekend blaming the Obama administration of wire tapping Trump Tower before the election.  Could this possibly be true?  Well, yes it can, and here is why.

In January, Andrew McCarthy published an article entitled, Fisa and the Trump Team.  In it, he reminds us if a national-security situation exists, the Justice Department can easily order a FISA wire tap without the evidence usually required to secure a wire tap amounting to evidence of “probable cause of commission of a crime.”  Using the 1978 Foreign Intelligence Surveillance Act (FISA),  it does not require that a crime has been committed, just evidence amounting to probable cause that the target of the wiretap is an agent of a foreign power. (A foreign power can be another country or a foreign terrorist organization.)  As we will see, Obama’s Justice department did order a series of wire taps on personal servers within the Trump Tower prior to the election and continued tapping those servers even after the election.

Now the media left is insisting Trump come up with the burden of truth after throwing out accusations about such a wire tap.  Most democraps are now saying that Trump’s tweets are just a “distraction” to take focus away from the Russian hacking scandal.

According to the National Review, this all started in the Obama administration in June 2016 concerning possible Trump links to two Russian banks which appeared on servers that were in Trump Towers.  The FBI wanted to launch a criminal investigation.  After a full inquiry, the Justice department found no criminal intent concerning Trump’s banking and business ties in Russia.

. . . it appears there were no grounds for a criminal investigation of banking violations against Trump. Presumably based on the fact that the bank or banks at issue were Russian, the Justice Department and the FBI decided to continue investigating on national-security grounds. A FISA application in which Trump was “named” was rejected by the FISA court as over broad, notwithstanding that the FISA court usually looks kindly on government surveillance requests. A second, more narrow application, apparently not naming Trump, may have been granted five months later; the best the media can say about it, however, is that the server on which the application centers is “possibly” related to the Trump campaign’s “alleged” links to two Russian banks — under circumstances in which the FBI has previously found no “nefarious purpose” in some (undescribed) connection between Trump Tower and at least one Russian bank (whose connection to Putin’s regime is not described). Of course, the fake news and media left will not point this out. It’s not a crime to do business with Russia.  Trump probably has bank ties to most countries in the world.  So, when the FBI after tapping the servers found no impropriety, no criminal charges were filed.  What is significant, is the Obama administration didn’t drop the probe.  They kept the file open or should I say, continued the taps.

Understand the significance of this: Only the Justice Department litigates before the FISA court; this was not some rogue investigators; this was a high level of Obama’s Justice Department — the same institution that, at that very moment, was whitewashing the Clinton e-mail scandal. And when Justice seeks FISA surveillance authority, it is essentially telling that court that there is probable cause to believe that the targets have acted as agents of a foreign power — that’s the only basis for getting a FISA warrant. That Russia tried to ‘hack’ the election is again laughable.  But the Democraps want to continue the narrative that somehow the Russians influenced the election and threw it into Trump’s corner.  First, hacking would actually imply that the Russians tampered with the voting process, which has not been proven.  It all comes down to the fact that the Democrats are upset about the Russians hacking the DNC emails, which did happen.  It was then exposed through Wikileaks.

Fox News even reported that Wiki leaks initially reported the hacks, but WikiLeaks founder Julian Assange has denied the Russian government or any other “state parties” were the source for the 50,000 emails, which fueled weeks of embarrassing coverage for the Clinton campaign detailing behind-the-scenes discussions and arguments among advisers and family members.  It was also reported that the leaks may have occured from within the DNC from a Bernie Sanders supporter who was disgruntled after learning that Hilary was undermining Bernie’s campaign.

This is the same DNC that spent 2 years trying to tell the American people the Hilary e-mail scandal was no big deal.

Now, when Trump informs the American people that Obama’s justice department tapped his servers in Trump Towers, the media left is asking for proof?  There is plenty of truth to the FBI investigation and FISA order that they did tap Trump’s severs.  Again, there is absolutely not a shred of evidence, proof or otherwise that Trump had anything to with hacking the DNC and its email accounts.  Apparently, we are told, that the Russians actually tried to hack both parties in the election.  Apparently, the Republicans protected their email servers much better because they were never hacked, as far as we know.

So, now, after an exhaustive Obama administration FBI search for eight long months into the supposed ties with Trump and Russia – non were found.  However, the media continues to draw a connection.  One example is when, in January, The New York Times reported three Trump associates were being investigated over alleged Russian involvement and then later conceded they could be wrong.  And now, Democratic clowns like Schumer and Pelosi continue to pursue and “independent investigation” into Trumps ties and the Russian hacks.

This is just another example of how the US government and the Obama administration has intruded into our lives and tried to harvest information against Trump before and after he was elected.  We really don’t know how many Americans have had their communications tapped and is under surveillance by the US government.  The FBI will not tell us and it won’t tell the congress, who apparently has the oversight of checks and balances to the FBI.  Now, congress is going to investigate Trump’s claims of wire tapping.

In December, NBC news reported that the CIA concluded there was a Russia Mounted Operation to Help Trump Win.  And guess who first broke the story?   You guessed it, The Washington Post.  More Fake news.

Living in a free society has its benefits.  Government taps have been happening for years.  Remember Watergate?  They just got caught.  Just think of all the situations where the US government has not.  So, remember next time you hear anything about leaks that shouldn’t have happened; the government is listening.

By its very definition, to propagate a FISA investigation, there has to be probable cause that the target of the wiretap is an agent of a foreign power.  Is Trump considered an agent of a foreign power or part of a terrorist organization?  The media left may have you think so.  Trump has continued to deny any connection to the Russian hacking scandal.  If it comes out that the Obama administration did continue tapping Trump’s servers and securing intel from his campaign, this could go down in history as the biggest abuse of power instilled by any sitting president.  It could be larger than Watergate itself.
